These terms and conditions should
Protect you from theft of Design
Protect you in case of litigation
Give you retention of title of goods in case of non payment and allow you to recover your goods (quite often a better threat than action)Please make sure all customers sign this before parting with any designs

good idea Robbie, especially as folk were putting their e mail addresses on the boards, can I remind people this is not a good Idea.

brilliant thanks!
after the recent discussion re wind damage, would a sign company be able to put a clause in the T&C stating that signs would not be replaced due to excessive wind damage? Unless the customer paid for this to be done?
or is that in breach of some statutory right?

Hi Dewi
Read section 9 very carefully.
This covers you for accidental damage, wera or tear and storm damage.

Have downloaded .doc file but haven’t read through it yet, but by the looks seems very comprehensive. It’s fantastic the stuff that’s made available on this site.
I think it is important to have contracts signed and good terms and conditions agreed to by clients as no matter how nice someone may appear things can change when it comes to payment after completing a job. I’ve also found that most clients take you a lot more seriously when asked to sign contracts as they see you as being professional, which of course we all are ๐ -

i only asked because to be quite honest i would not expect any of my customers to read all that, then make them sign it!! ๐ฎ i was just curious if it was to be printed for own use (info) or it had to be included on anything relative!! ๐

I do not expect to have to use these terms and conditions for 99% of my customers. But for that 1%
If i threaten to remove a sign for non payment the law is on my side witout these conditions I could be done for theft.
If i spend 3 weeks designing corporate ID for bus cards, signs workwear etc and then the customer goes to someone else for manufacturing I own the design and can ask for payment or stop them going ahead.
If a sign falls down whether it was put up incorrectly or it has been modified by someone else, or the builidng fabric deteriorates, or high winds etc I have legal protection.
If a cutomer has stolen copyright material and we inadvertently publish it we are covered.
If we are delayed in the manufacturing of a sign by a material issue outwith our control and the customer decides to cancel an order halfway through production and we have already bought expensive material we are covered.
But generally this lays down the law in your favour as opposed to the customer. There are many wide boys out there. These terms and conditions are not to make you cowboys but to protect you from them.
I do not expect you to put these on the back of your invoices because by then it is too late. When you start work for a customer or when you present your fist drawing of your proposals, get them to sign your drawings and the terms and conditions at the same time, if it is a genuine customer, they should be quite impressed that you are a professional
Regards ADrian
P.S. Really quite chuffed about the interest, its nice to make a contribution
