  • Planning permission resposibility

    Just taking an order for some new business signs, two of which will be fitted with 20 ft of the edge of the road directing visitors to the business. I’ve made it clear that any planning permissions for fitting signs need to be applied for by the client. The signs are low and discrete, no lights and non reflective.
    My question is – would fitting the signs without seeing planning permissions make me liable, despite making it clear that we do not apply for permissions?

    i dont think that you would be liable for anything by fitting but if your client is not the onwer of the property he cant apply for permission to do anything, he does not own it,also on fitting anything to a rental property the owner needs to agree to the work/changes to his property.get legal advice before you do any more :)also if there on public property your client cant have any insurance for them.

    Might be different in Ireland but in Scotland anyone can apply for planning permission

    You are by law obliged to inform your customer that they will need planning permission, but the actual planning application can be done by either party. I always tell my customer to do it as we no longer do planning permissions due to the council repeatedly moving goalposts and messing me around making the application non profitable.

    I believe in this country anyone can apply for planning permission on anyone else’s property…Thats what I’ve found out recently on a house Im buying.
