• Photos on Leaflets

    Hi All

    Has anyone used photos of work they have done on advertising material
    such as leaflets etc.?

    Bearing in mind that the subjects are usually on public display i.e. on a fascia or on a vehicle did you ask your customer’s permission to use them on printed material?

    If so was it because there is a requirement to do so or did you do it out
    of courtesy?

    As you have probably done the design and layout, you own the copywrite so there shouldn’t be a problem with using any photo’s you have taken. I use them for yellow pages ads without any recourse.

    If it was a job where all the design & layout were done by the customer
    or someone on their behalf I guess it might be prudent to run it past
    them before using it.

    id usually call our clients first anyway, they rarely say no.

    its publicity for them anyway! 🙂

    but, yes, you own the copyrights to the designs

    Chris, I would always call the customer first, I have a pretty good relationship with my customers anyway and can’t think of a single one that would say no. Put it this way legally you may not have to contact them but if you went ahead and used something without the customers permission they may not be able to take any legal action but would they use you again? Keeping customers so you get repeat work is very important in any business i wouldn’t want to take the chance.

    As has already been mentioned it is free advertising for them as well so it is very unlikely they will say no.

    I wouldn’t dream of doing it without asking. It’s only polite.

    Most customers are only too pleased to agree.

    i designed my leaflets in a fairly short time, deadlines and all, so it didn’t occur to me to ask permissions, though i guess it is only polite.

    all of the work is my own, and on public display, so i guess i own the copywrite for the design, and the copywrite for the photographic image, regardless of it’s content !

    of the ten or so customers who’ve seen the flyers since, they’ve all pretty much said thanks for the free advertising !

    i dont really see it as being any different to posting the photo on your website for potential new customers to look at,

    the only customer who’s ever brought it up in a not so happy voice, was a customer who’d seen a pic of their truck i did, when advertising something on ebay, when i mentioned the fact that it was free advertising, and i own the rights anyways, he seemed ok, then mentioned, tongue in cheek, and with a smile on my face, that if i charged him the going rate for his trucks, rather than the give-away price i was, then i wouldnt need to sell junk on ebay !

    Hugh, I wouldn’t put a picture on a website before I had asked the customer either, I just see it as being polite to ask. I know you own the copywrite and there is no legal comeback but I just see it as good manners and if a customer were to say no then I have enough other customers that it won’t make a lot of difference to me and they will lose the free advertising.

    Hi chris, we also have a printing side to our business and design flyer’s for company’s like sign makers and others that advertise customers work, and you don’t have to get permission but its always nice to ask a customer first, you only need permission if you intend to use the same design with another customer of yours.

    I can see your point, Martin, but it just never occured to me when i hurriedly dug out pics to get the artwork off to the printers in time,

    same with the website, really, i personally see it as free advertising for the customer, most of the customers i deal with, take it for granted that we advertise each other via word of mouth, or any other way,

    i usually ask for the customers cards / flyers if i think it’ll be of any use to my other clients, even if i think they don’t do a service i think i could recommend, i’ll still ask for them, that way i always get asked for flyers or cards in return, and as a result, i have received, and passed on, alot of work in that manner,

    The thing about posting pictures of jobs without asking the customer first, is that we are assuming that the customer is 100 % happy with their experience and product. . So a quick phone call could save a bit of embarrassment later on !

    Now I’m sure you fine bunch treat your customers like kings but I find it hard to believe that the every single sign maker on here has a 100% customer satisfaction rate. 😉
