franchise question

the job has basically gone bad
the franchisee has gone out of business
do i have any recompense on the franchise company?
or am i basically up the creek without a paddle?

Depending on how the franchise is set up you should be able to go after the parent company as they take quite a bit from the franchisee in fees, surely some of it will cover collapsing franchisees!
If not, name and shame them into paying up by repeatedly using the company name!

Interesting question Nick,
I would guess that any franchisor worth his salt would have the contract sewn up so as to insulate himself from any misdemeanours by his franchisees. But how are you going to get hold of a copy of the contract to be able to check? I think you could spend an awful lot of money on lawyers, and still come up empty handed. 🙁
My own experience is that, when employing subbies, you shouldn’t look at the franchise. Some franchisees are very good whereas others, trading under the same banner, are hopeless. I treat them all as individual businesses and only use the ones I think I can trust individually, regardless of the sign above their door.

I concur with my colleagues above. Name them. It probably won’t shame them, but at least it might help others amongst us avoid making the same mistake.

I wont name and shame them just yet as i have managed to speak to someone from the franchise company
they are at least willing to look into the situation and see if they can work out a solution
so rather than name and shaming them i may end up promoting them for going above and beyond.
