Question about copyright infringement
Hi guys, I have a question about copyright. When we make up a design for a customer, sometimes they ask for an image for the design. I do a lot of high res photography myself so most things I have, we also do product photography and when we do anything standard like wedding cakes or jewellery, we offer the customers a small discount to sign a release form to use the image in our designs, although we own copyright to the photos we consider it courtesy to ask for usage rights. So we carry quite a lot of stock images.
Occassionaly we have to source and buy images on line which we charge an additional fee for. My question is this, is it ok to use these in the designs without buying a licence? We only do this as a one off for each customer and we buy it on their behalf, showing clearly in the invoice what and where we purchased.
Can I re use this image for other jobs? We don’t advertise the images for re sale it’s just when required.
Also, I produced a couple of big images of well known kids tv characters for a customer that you can put your face through a hole for taking pictures of on 10mm board. She wants to know if it’s ok for her to sell them via ebay, not as an ongoing thing but just to sell them on to someone else instead of keeping them.
She did ask me if she could rent them out to other people for thier parties, but I’m pretty sure that it would be copyright infringement, not just of the image but also of intellectual property rights.
Can anyone cast any light on any of the above?
