    Hi Guys
    Just wanted to get someone Else’s opinions on this
    I have been sent a graphic to digitize for the back of a customers jacket.
    My problem with that is, its of a Harley Davidson, and as much as I would relish the challenge to recreate it in stitches, surely it has to be subject to copyright even though its in thread?

    The end product he requires would be 8 inches in diameter 😮

    Am i being over cautious? I realize that screen printing or reproducing it in full colour print is a no no, surely the same applies to thread?

    i do think this applies in recreating in anyway… if its just a one off, then ide maybe do it but possibley get customer to sign something. but… if these are in multiples of any sort you could face heavy fines as your customer maybe selling them on and will only point the finger at you if caught. not worth the hassle, keep yourself safe 😉

    is it the harley logo, or a harley bike.

    if it was the latter, i recon you`d be ok.

    if it was the logo, then tread careful.

    we sent off a football teams logo to be digitised for their supporters club.
    the firm sent it back saying without the ok from the club they couldn`t do it. the customer did get the ok from the club, so the job went ahead.

    while it might look like a good little earner at first, get that dreaded lawers letter and the profit somehow just doesn`t seem worth it.

    The Harley Davidson logo is readily available on the Impact cd, if there was legal implications would they not have already checked it out?

    if you read the disclaimer on the cd, you have to ask the owner of the logo before using them….

    I also believe Harley Davidson are very stringent with who uses their logo.

    I’m sure there was a thread on here way back regarding this and that was just the use of the harley shield (which i believe is also copyrighted)

    Thanks for all the input. I have contacted this guy and explained that unless he has permission I cant digitize this for him.

    I kinda find it bizarre that he wants it to be 8 inches in diameter anyways (the bike), this would normally be applique, oh well.

    All different folks, all different strokes!

    What would happen if he had wanted it tatooed on his back?

    Would the tatooist require permission beforehand.

    If he went ahead regardless, could they force him to remove it? 🙂

    It is ALWAYS the responsibility of the customer to check copyright issues when he requests a particular logo and up to him to get any necessary permissions, so in this case don’t worry go ahead and do the job.

    not necessarily mate… hes only asking, your the one recreating it!
    once you accept money for it & he pays you for it, both you & him are breaking the law. unless you give him something to sign that he tells you its not being sold on and that hes asking blah blah blah…
    not trying to be smart here mate, just mentioning it so you are careful…
    its NOT always apparent what is and isnt copyright or what actually breaches copyright, but something like the coke logo, BP, Virgin… are all obvious… better safe than sorry is all im saying 😀

    Doe anyone have a ‘disclaimer’ that they use regularly to have their customer sign?

    I know in theory that its there purely to scare the living daylights outta them about copy write issues. I just thought this might be something I attach at the bottom of all my emails or even the stitch-outs I provide.

    I rarely get to meet a customer now, as I deal purely on line (aaah the joys if technology!
