Advice needed
Posted by Steve Vallis on 12 February 2008 at 20:12I have been told today that my non solvent large format printer is to be replaced.
It has not been working for 8 days & is only 6.5 months old.
This is my SECOND machine in 9 months.
Can I legally claim for loss of earnings?

I would doubt it, as the company responsible is doing everything they can to put it right, If they don’t supply an instant replacement or come out to fix it immediately according to level of warranty cover you may have recourse, but if they have done everything in their power to correct a fault and promptly I would say no.

it’s very doubtful. as with any equipment you buy, cars, washing machines etc, the supplier is only legally bound to supply goods fit for purpose.
and it is only reasonable to expect just that, if the goods go wrong, as can happen with anything, then all you can expect in a court of law, is a refund, or replacement. Consequential loss can and should be covered by your own business policy.It’s like one of your customers asking to be compensated for loss of sales, because you made a mistake on a sign, you would only be responsible for a replacement.
Only exception is if the supplier was negligent, in supplying or manufacturing the goods, and to proove that, you would need a class action, e.g. many customers claiming the negligence.

You could try lying under the printer when they bring the new one, and hope they drop it, then claim. :lol1:
