    I have a complete ar5e of a customer wo despite agreeing the proofs and accepting the quote via email, has now decided after installation that they are not right. I am not sure that my T&C’s – which other than the basic terms on the quote are available upon request, will be sufficient.

    Does anyone have a copy of terms & conditions to go with artwork proofs that will basically say – "you agreed it, tough titties"

    this is a matter of some urgency as an unsatisfactory reply to my email will result in a customer having no signs in the morning – they chose the wrong week to pee on my fireworks!

    ps.
    the dispute is over two main matters…

    1) the ‘&’ behind the main name should have been violet,

    2) apparently the characters, ballerina and logo are all smaller than the proof… she’s got me on the ballerina – the crap artwork supplied had a big white box on it which I didn’t remove when sizing it for print.. I’ve offered a refund on that bit.

    otherwise within a few % it is as per the proof which she agreed "proof all good – just make the number red or purple and same font"

    she only supplied images (all woefully inadequate) after the proofs were produced (from photo’s on site) and due to the quality, only the characters and ballerina were supplied and used as I could not recreate them on a non existent budget.

    I have roughlty scaled the proof and the photo to demonstrate this but she’s going off on one… ultimately she was too lazy to check the proofs properly.

    Can I have opinions please?

    Remember, your terms are no use being displayed on the back of the invoice, or even when the designs are done.

    Once a quotation is accepted the contract is formed – thus your terms must be visible prior to the customer accepting, otherwise they’re worth nothing.

    It’s a technicality but will stand up in a court "sorry your majesty I didn’t know about that because I only saw the terms when the job was completed"

    My basic terms are clearly on the quote she accepted, including checking and signing off proofs.

    I personally feel she’s trying it on. I am wrong to have asked in hindsight I guess but this woman is driving me mad.

    I think any reasonable judge would agree that the sign looks as it does in the proof Hugh.

    Sounds like you’re dealing with a complete idiot……Its exactly the same as the proof !
    If the "&" was in violet it would run into the colours of the other letters.
    I Personally wouldn’t mess around with someone like this and I would go and take it down just out of spite, and tell her to stick it where the sun don’t shine.

    took a hit in the end to just get paid, knocked off a % to cover rrp cost of the images, ultimately dropped £100 form the invoice and it saved me taking them down – they’re doing it in a few days time when the other signmaker puts up exactly the same sheite!

    I had a similar issue a few years back….

    I just went down took the damn sign off…..Low and behold has a call in the morning asking to fix the sign back and everything was ok.

    Charged him a second fitting charge….Never had an issue with him since, infact his had more bits done.

    Some times the damn customer isn’t always right and the ones that are a pain you need to make sure they know who is boss.
